Indemnity

You, the client, agree to indemnify Blackthorn Heuristics and its staff from time to time (‘us’) from and against all losses and liabilities (including without limitation legal and other professional costs and expenses on a full indemnity basis) which may be incurred by any of us, arising out of or in connection with any act or omission on your part; or any tortious act or omission, breach of any contract, statutory obligation, equitable duty, codes of conduct or by-laws of any educational institution, fraud, dishonesty, wilful misconduct or unlawful activity, in each case on your part; or any claim or action based on an allegation that any material submitted to us infringes any entity’s intellectual property rights or breaches any contractual obligations, legislative obligations (including under the Privacy Act 1998), fiduciary duty, or obligations of confidence owed to any entity.

Limitation of liability

While we undertake to use our best skill and judgment in providing the services, we do not make any warranties or representations in respect of grades likely to be awarded to you by your academic institution for work you submit. The individual judgment and discretion of the academic staff ultimately grading your work is a matter beyond our control and you acknowledge and accept that we accept no responsibility for the final grade you receive. To the maximum extent permitted by law, we exclude completely all liability to any person for loss or damage of any kind (however caused, including by negligence) arising from or relating in any way to the services we provide. Where any law implies a warranty into these terms which may not lawfully be excluded, then to the maximum extent permitted by law, our liability for breach of the warranty will at our option be limited to the supply of the services again, or the payment of the cost of having them supplied again.

Privacy

You need not disclose your identity to us in order to use our services. However, this website may use “cookies” to collect anonymous traffic data from users who access this website. Our internet server may also automatically record details about any computer used to access the website, the date and time of access, and details of the information downloaded. This information is used for internal statistical purposes and to improve this website.
